Legal Question in Family Law in Texas

Hello I have a 7yr old son how currently is living with his father and I am tryin to get him for the summer but his father is only willing to let me have the child if I'm willing to write a letter and have it notarized saying that I will be send our child back to him in x amount of days. Also there is currently no custody of the child!

I am in the process of getting custody so I was going to give him the letter he wanted so I could get my child but had to no intention of sending the child back! So with that said could I get in any legal if I didn't send the child back or is the letter worthless unless he wanted to get a lawyer
