Legal Question in Family Law in Texas

My baby was born a little early weighing 5 pounds 12 ounces at birth and lost several ounces before we left the hospital. His "practitioner" he saw his first week of life said give him formula. It took a few days for my milk to come in but when it did it was an adequate amount so I did not give him formula, I strictly breastfed. His father and i got into a situation where he left with the baby and his "practitioner" now says that he is under weight, malnourished and dehydrated. Is this considered child abuse or neglect since I know I had more than a sufficient milk flow? He is trying to use that against me for custody and I have not seen my child in a week.

Are you in Court? Has a divorce been filed?

You need to file a divorce petition and ask for temporary orders.
