Legal Question in Family Law in Texas

cps has conservatorship over my children but they are in my possession. my wife has limited contact. 1st question is can I file for divorce without a custody agreement in place. 2nd question is can I get a custody agreement in place while the department has control

Yes, you can file for divorce.

The SAPCR that the CPS folks filed will be transferred into your divorce case and consolidated with it. You will probably have a new judge.

You don't need a custody agreement.
