failure to pay child support, upcoming court case

I have a six year old daughter and her father is in jail due to revoked probation. he will be released in march, and has a court date coming march 20, in texas. I want to be there and know what happens with the case. I have been told my presence is not necessary, but I still want to be there. He has lied to me about everything. He is almost $20,000 behind in child support. I know he has a new child who lives in texas and I want to protect my daughters rights. He has only spent approx. 11 months around her in her entire life. The last check I recieved was in july of 2003 for$13. Should I go to texas and appear in court or should I simply request the reports? He has prior felonies, a drinking and smoking problem and is an unfit parent. I have no clue what to do and need advice to help me decide how to go about this matter. If do go i will not take my daughter to the court with me or to texas for that matter, she has no clue her father is in jail and i keep her sheltered from such things, she is too young to know such things. thanks for your time.

Federal and Texas law allows for you to testify (if your testimony is necessary) by phone. Coming to TX would likely be a hardship for you and I doubt that your physical presence will make a great difference. See if you can contact the Asst. Atty General on your case and tell him/her that you are available to testify by phone.
