Legal Question in Family Law in Texas

My husband wants a divorce and has been calling the police stating I am harassing him but I wasn't and wasn't in the same room with him. He has done this twice. He went to the police station and tried to make a report about a stolen key but they wouldn't. He called yesterday to say his locked office in our house was tampered with. Let me mention he put locks on one bedroom door and an office. Both contain possessions of mine. He was told he cannot do that because it is community property. I think he is setting me up and trying to get material to have me removed from my house.

I assume that you and he are still living in the same house.

File for divorce NOW. In the petition, ask for temporary orders that award to YOU the temporary exclusive use of the house. I assume that you would be able to make the payments on your own.

You can even ask for temporary exclusive use of the house for YOU, with HIM making the payments. The Judge will either say "yes" or "no."
