Modifying Child Custody

Prior to 1/10/05 1 child lived with me and 1 with the father. We are modifying the parent child relationship so that both children live with me. Since he is going to have to pay child support now do we have to appear in front of the judge? Or can we just file the petition to modify and let the jugde review, sign and send back? Then would we just take the support documents to the child support office for them to get the support information started?

I urge you to retain an attorney.

It appears that you have a voluntary modification. Yes, you need to file a petition to modify. You also need to prepare a final document for both parties and the Judge to sign.

You also need a withholding order for the Judge to sign. You will then need to send a certified copy of the withholding order to the employer to begin withholding.

You can, of course, to the Texas Attorney General's office, and get them to do the withholding. It might take awhile to get them to do the paperwork to get the child support withheld.
