2. If an item was given to someone and then abandoned for 5 months before a request was made to have it back, are there legal grounds?

Based on what you have written, generally, it must be understood by both parties that the item(s) being transferred were actually "gift(s)." As for the Statue of Limitations (SOL) on an assault charge, it would depend upon whether you are seeking criminal or civil charges. Under the Texas Code of Criminal Procedure the SOL would be found in Chapter 12. Under the Civil Practice and Remedies Code the SOL would be found in Chapter 16.
