Legal Question in Civil Litigation in Texas

Daughter being sued

My daughter is being sued by her ex boyfriend for the new truck he bought her. Saying it was conditional upon their marriage. He never offically proposed nor gave her a ring. He is also suing her for the amount of other gifts he gave her. The truck title is in her name. Can he do this?

Re: Daughter being sued

He can sue her. The question is whether he will win or not.

One question that may be key to the issue is who broke off the relationship.

There's caselaw where the woman had to return an expensive engagement ring when she broke off the relationship. Whether that may be applicable to the truck and other gifts is seriously open to question.

In any event, she will need to get a lawyer to defend her in the lawsuit.
