Legal Question in Civil Litigation in Texas

He won't give me my car back!!!
Me and my ex boyfriend filed our taxes married this year and got $4100 back. We went and bought a $3000 car with it but put it into his name for insurance reasons. Now we are not together and he will not give me the car or my half of the money for it. Neither of us were working and had no income at the time. So can I prove that we payed for the car with our income tax and file claim in small claims court to get half of what we payed for the car back?

Other than defrauding the IRS, what else are you going to admit to in court, under oath? Care to try to prove up a common-law marriage?
