Legal Question in Immigration Law in Texas

H-1B visa

One of my family member is a South Korean national who is in the US with his wife and 2 kids on travelers visa. He has been here since 28th of January, 2008 and is trying to prepare to file for H-1B visa with a company that employees over 30 employees. I have been informed by a person practicing law that it may be unfavorable to file for visa in such a short period of time. He says in his experience it is recommended to file at least 60 days after entering US. He has 4 years degree in Chemistry has worked for a company over 10 years in Korea in similar field of work in managerial position.

The reason the lawyer suggested you wait is that immigration has the right to question intent. If someone files that soon after entry, then it could cast suspicion on the original intent. A few more days wait, and a solid application process will serve him better.
