Legal Question in Immigration Law in Texas

Hello

I am from Mexico. I am living illegally in the United States for more than one year. Before I entered illegally to the USA, I asked for a B2 Visa to the USA to the USA and it was denied. I have a son, and he is a US citizen, now I have a sponsor to fill a H1-B application.

What are my options or suggestions, maybe to ask for a waiver under the H1-B visa petition?

Unfortunately, you are not eligible for a change of status to H-1B (because you are illegal). If you go abroad and apply for H1B visa, it will be denied. There is no available waiver here.

How old is your son? If over the age of 21, and you leave the US, you may be eligible for a waiver, and LPR. You will need to speak directly with an immigration attorney to explore what, if any options, you may have.
