Legal Question in Insurance Law in Texas

verbal agreememt

i was recently involved in an auto accident, where i hit someone from behind. the car in front of me started to take off so i started to take off, then if stopped. the truck was not damaged much. i had no insurance and the police were not called. we came to a verbal agreement that i would pay 300.00 of their deductible and that would be that. i paid a week later. now i have been getting messsages on my phone that i need to pay an additional 300.00 because they are not filing with there insurance because it would cause there insurance to go up. i have no money and am going thru a divorce with two kids. i had to borrow the money to pay them and am trying to get back on my feet. i did sign a piece of paper stating that i would pay the deductibe which i was told was $300.00, now it it a different amount. they have also been threatening that they will get a lawyer nd make me pay. what can i do. i have no more money to give them!

If you have no money to pay, then you might wait for them to sue you and then defend the suit by arguing payment. They may never do it. It's hard to be any more specific about your options without knowing exactly what you signed, what your conversations were, etc.

As an attorney who has specialized in personal injury cases for 22 years, I can assure you that no lawyer is going to take a case, file suit, and fervently pursue an uninsured person for $300.00. If I were you, I'd forget about it and go get a good night's sleep.
