Legal Question in Landlord & Tenant Law in Texas

Landlord says in court I paid rent, now I'm getting a bill!

In May 08 I signed a lease for one year, my first apartment. I moved from out of state and had a limited amount of time and a limited budget. I used an apartment locator who showed me a nice unit at the right price. On move-in I was given a unit that was nothing like the one shown, was filthy and infested with roaches, and was in an area so far from the office I had thought it was a different property. My options were zero at this point and I resigned myself to suffering through the year with the silver lining of saving money becasue of the lower rent. Management changed in Oct and at the beginning of Dec I recived and eviction notice and order to appear in court. I contacted management who stated that their records showed I had not paid rent since September! They agreed not to force the eviction until the matter had been settled in court. I did not have records showing that I had paid and tried unsucessfuly to track the moneyorders at my cost. This spanned 4 apperences Jan, Feb, Mar and Apr. The management agreed to settle out of court for a payment plan. May 12 I got a 72hr notice to vacate. I moved in 24hrs and have recived a bill for Jan, Feb, Mar, Apr rent, releting fee, cleaning, new carpet, etc. Any advice would be helpful

It sounds like it is time for you to sue them in Small Claims court. Bring your proof of payment for those months (AGAIN), ask for damages and attorney fees for wrongful eviction.
