Legal Question in Landlord & Tenant Law in Texas

roommate contract

My daughter is renting a house. Lease contract is in her name only. (Leasor is friend of family). A roommte is moving in (with Leasor permission) but roommate is only 17 yrs old. My daughter wants to write up an agreement/ contract between the roommate and herself (respon. for half of rent, utilities, etc). My question is.. would the agreement/ contract be valid since the roommate is only 17? Also, is there such a form already available that just has to be filled out. One roommate already moved out unexpectedly leaving my daughter with all the bills and we dont want it to happen again. Thanks for all of your great advice!

Re: roommate contract

The agreement would be a sublease, and would not be binding on the roommate, as she is legally incapable of contract. Maybe her parents are willing to cosign the lease.
