Legal Question in Medical Malpractice in Texas

Copy of medical records

Can you tell me how I can get a copy of my mother-in-laws medical records from the hospital and her doctor? My husband and I both have Medical Power of Attorney and would like to know how to go about getting the records for a possible malpractice lawsuit. Thank you

Re: Copy of medical records

the easiest way is to have your mother in law sign a medical authorization permitting you to get the records. some hospital have authorizations that are acceptable to them under the privacy act on their websites that can be downloaded. that authorization can also be modified for use to request the doctor's records. if the medical power of attorney specifically provides you with authorization to obtain her medical records a copy of the power of attorney may work as well. hope this helps. bill featherston
