Legal Question in Personal Injury in Texas

I had an accident in August 2015. The guy who hit me was not supposed to be driving; he pled no contest in court and received probation. An MRI showed I have 2 herniated discs and torn cartilage in my knee; there is additional nerve damage and I'm in pain. My attorney says that the adjuster is hard to work with and the company is notorious for not paying much. They have issued a "final offer" that is a third less than the amount their review board found medically necessary. My attorney is now focusing on setting up a payment plan for me to pay the bills and says its no use fighting. I've not been reimbursed for rentals or medication or doctor's visits paid out of my own pocket. The only amount I have recovered has been to sell my vehicle to the body shop at a loss because the adjuster only approved a used gas tank to replace my ruptured one, and again, I was told the adjuster was just too wily and I'd do best just to accept it. I'm in Texas. What will happen if I switch attorneys? I was told due to the policy limit, if I fire my lawyer, they'll still be entitled to a third and I'll end up with nothing.

You can fire your lawyer. If you fire them, they may still be entitled to a lien. However, many lawyers will work with you on this. Get a second opinion, most lawyers will give a second opinion at no cost. Also, you may be able to work out reductions from medical providers such that you're not out so much. I'm assuming you don't have first party insurance.

You need to file suit against the other driver. Talk with your lawyer and ask them what the policy limits are for the at-fault driver. If you lawyer won't fight for you, find one who is not afraid to go to trial.
