Auto Accident

I was hit in the rear doing 1200.00 damage to my vehicle. I have had pain in my back and neck.

Can I get lost wages back on a small accident claim?

You are certainly entitled to claim lost wages, medical bills, physical pain, and mental anguish. Whether the insurance company will willingly pay you what you are entitled to is a totally different matter. Increasingly these days insurance companies are refusing to offer fair settlements, forcing even "small accident" claimants to hire attorneys. My guess is that you will eventually have to retain a personal injury lawyer to help you. You might consider doing it now rather than later.

Usually consultations with attorneys or their offices are free for this type of case. Whether it will meet the criteria to be accepted is a different matter. Do you have full coverage insurance. Might be better to make your claim to your insurance company and let them go after the other driver's insurance.

If you have personal injury protection, it will pay 80% of your lost wages up to the limits of that coverage. In addition, you can seek your damages from the driver who hit you. Only your net income, however, is recoverable.
