Legal Question in Personal Injury in Texas

was in car accident have disk issue in neck I sign with a attorney when this happen I have try to call them to talk or set up a meeting the last7/8 weeks I only get to talk to office lady she just tell me to keep going to the doctor and my attorney will call me the next day still have not talk to thim my ? is can I change to another attorney since I am not happy with things with them

It would be better if you requested another appointment and ask to meet in person and let them know you may wish to change attorneys if you can not speak with the lawyer. Lack of communication is the main reason that we get calls from people wanting to change personal injury lawyers. But, changing horses in the middle of a race is not a good idea in about 98% of the cases. If you are still being treated, there will be little if anything for the attorney to report on your case no matter who the attorney is handling the file. Nevertheless, the attorney should speak with you, and many avoid that unless their is something new to report or you have a specific question. It is no excuse that personal injury lawyers get paid on contingency and try to keep their time down (as they are not paid by the hour), they should be available to you as needed. Also, many attorneys have case managers or paralegals handling the file day to day and who know the answers to most questions a client has. Do you expect the attorney to have an answer differently from the office lady?

You have the freedom to use any attorney of your choice. Personal injury claims, however, almost always involve a contract; so there are contract rights involved. In most instances, those contract rights get resolved without additional cost to the client when the client changes attorneys.
