Legal Question in Personal Injury in Texas

I was in car car accidents a week ago and the person hit me from the back, she had no drivers licence or insurance, she fixed my damages on my car but I wuz injuried in da accident. Now I have a doctors bill and I feel like she should take care of it. Now she avoiding my phone calls now so can I take her to small claims court for that and for pain and suffering and lost wages cuz I had to miss work for two days?

Yes, you can take her to small claims court and get a judgment against her. Since she did not have insurance, you might be able to file the judgment with DPS and they might not let her get a license until the judgment is paid. It's a tough situation when there is no insurance.

If you have uninsured motorist coverage, medical payments coverage, or personal injury protection on your own insurance policy, then you may want to consider making a claim that way.

Mail her the bill and a letter from your employer showing your lost income. Maybe she'll respond to that.

You can file a uim claim with your insurance if you have that option. I would contact your insurance and tell them about the issue.
