How do I know what a fair settlement is if my doctor said I'd need surgery in the future?

When I as a personal injury attorney evaluate a case for settlement, I obtain from the doctor a "future care cost estimate" in which the doctor estimates the cost in dollars of any future medical care needed, including surgery. I include this in my demand to the insurance company.

If you are represented by a personal injury lawyer, he should be in the best position to advise you whether or not a settlement is in an acceptable range. Insurance companies in a number of cases are reluctant to pay a fair price for the possiblilty that one may need surgery in the future. If you do not have a lawyer, then you should consider hiring one, especially since your case is complicated by the need for future surgery.
