Legal Question in Personal Injury in Texas

Individual was traveling on road in Texas.. As he entered the intersection, a vehicle without warning charged into the intersection and collided with his vehicle killing him he died of unrelated causes. Can we sue his parents as �personal representatives� of his estate, or do we have to open up an estate in probate court? The kid was 20 at the time of his death.

If you do not take out an Administration, there is nobody to serve with the petition. you must take out an administration
