Legal Question in Personal Injury in Texas

My mother 70 yrs was in a car wreck around 8months ago in Texas Not at fault There seems to be only 75k avail from her PIP and the person at fault policy. She has occurred an astronomical medical bill. She has Medicaid and on ss She has an atty who seems to working on the case taking 40% She has not been released from Doctors care. Question She was told by an insurance adjuster she can sue her own insurance company for not offering her any options to up her coverage when the policy was written. She will most likely not be able to return to work. She had jobs lined up prior to the accident. What can we do to help her, Thank you Dan

Her lawyer should be able to answer that question for you. I doubt she would be able to maintain an action against her carrier for a claim that the agent failed to tell her that she could have chosen higher policy limits.

You need to go in and talk to your attorney i would not suggest that you go out on your own and sue the insurance company without your attorneys approval.
