Legal Question in Personal Injury in Texas

My son thats 16 years old, He had a accident at school in Agg shop, A 15 ft Batwing mower fell across his right foot Breaking all four toes from his big toe down crushing two of his toes,We have insurance on him, But is the school Liable if he has a Disabillty in that foot, excues my spelling.
