Legal Question in Personal Injury in Texas

My son who is 12 years old was held underwater by a 16 year old lifegaurd because he accidentally spilled his snuff can. The 16 year old took his foot and pressed it up on his shoulder blade and held him under the water for about 15 seconds. My 12 year old son has severe asthma. Can I file assault charges?
