Legal Question in Personal Injury in Texas

Underage Drinker

My 19 year old son was involved in a auto accident 5 days ago in Houston, TX. He and about 4 of his friends were drinking in a local bar. He did not have an ID on him. He was never asked for ID. And he and his friends were allowed to buy pitchers of beer and drink until he was very drunk. He drove his car only a short distance before hitting a tree at a high speed rate. He was hospitalized for two days and is now at home and is in intense pain from his back and neck. He has two gashes on the back of his head, a small gash on his chin and scrapes and many bruises. I repeat, he in in a great deal of pain. He could have been killed or could have injured others. Can the bar ( which is a popular and well known bar) be held liable for not insisting on ID from my son?

I would much rather he be ID'd and turned away from entering the bar and come home mad than the condition he is in now. I understand he may have long lasting problems from this injury. My son has told me that other friends of his have been allowed to enter this bar and drink without showing ID. Most of my son's friends are 18 - 19 yrs old. Any advise is appreciated. Thank you.
