Legal Question in Real Estate Law in Texas

Home Owners Assoc

I own a home in Texas, which has been rented out for the past 2 years. We were late on paying our homeowners, due to financial hardship. We now owe 1000. The state of Texas is sueing us, and proposing to sell our home at public auction. If we pay the amount in full can they still procede with selling our house? This is all for 140.00.

Howdy:

They can't sell the property if you pay the bill. And, it's probably the HOA, and not the State. And, it's not $140 ... it's a grand. You said so. It might be $140 a year, but it looks like a large number of years, plus penalties, I guess.

But, don't wait until the day of the sale. Pay the bill as soon as you can; or, contact the HOA about making arrangments. All they want, after all, is their money.
