Legal Question in Real Estate Law in Texas

mortgage payments

Our mortgage company raised our payments by $600 as of May '03, however we had already sent the May payment for the old amount, which would be a partial payment, but THEY ACCEPTED THE PAYMENT. Does this not constitute fair and legal notice that they will accept partial payments in the future?

No. Your loan obligations are outlined in your Deed of Trust and other loan documents. You should have received copies when you purchased your home.
