Legal Question in Wills and Trusts in Texas

person dies - no will

Man dies leaving 3 biological children and one step- child and widow. What is the TX law dividing up the property which was in excess of $500,000. The man died approx. 10 yrs ago. Does the stepson have any rights or does he inherite anything or is it up to the widow (stepson's mother) and biological children? This man supported stepson through high school and college.

Re: person dies - no will

If there was no will, then the property descends according to the laws of intestate [no will] succession. 50% to the widow, 50% divided equally between the surviving biological children.

Unless specifically mentioned in a will, a step-child inherits nothing if s/he was not adopted by the deceased during his/her lifetime.
