Legal Question in Wills and Trusts in Texas

No Present Will

My husband made a will in 1992 leaving his house to his wife(divorced now) and step-son. He did a quitclaim which she signed but he has not made a new will since we married and my name is not on the house.If he dies, will I lose my home? Will I have to go through probate court?

Re: No Present Will

Under the circumstances you would retain a life estate in your homestead. You will not lose the house. You'd be responsible for the taxes and insurance.

You may have to go through probate court.
