Legal Question in Workers Comp in Texas

Old Injury,required Spinal Surgery,recurring pain now need Medical Attention

I was injured on the job in 1992 in Texas,I required surgery of my spine (L4-5 fusion) the hardware is still in place.I woke up 3 days ago in pain and need to see a doctor I have not reinjured my back.I called the insurance co.that covered my company as I am supposed to have lifetime coverage on this injury they refused to help me or grant me authorization to see a doctor.They claim they have no record of me ever being injured.Do I need an attorney and if so do I need one in Tennessee where I reside now or in Texas where the accident occured? Please Help I dont know what to do,I cant get help till I can get Authorization from insurance co.

You need to get a copy of the court paperwork (court order) where you settled you case in 1992 and then contact the insurance company and send them a copy of the order. If they still will not provide you with a doctor, you will have to file a lawsuit against them. It can be done in Tennessee if that is where you now reside..

Send the insurance company a copy of the order in the workers comp case where the medicals were kept open. They should authorize medical treatment. If they refuse you will need to file suit and can do so in Tennessee since you reside in Tennessee.
