To establish the trusstees rights to assets of the bankrupt (now discharged} the trusstee has to go to the high court in London can court costs be made against the discharged bankrupt in the event that the trusstees application is successful.

In any insolvency proceedings the normal costs principles apply and costs are generally awarded to the winner
