Legal Question in Family Law in United States Minor Outlying Islands

Child Custody in texas

I was divorced almost 2 yrs ago. My ex husband has a long history of Alcohol abuse, he physically abused me infront of our children he was arrested and charged. He is currently on probation for a DUI and in anger management. Now that the divorce has finalized I have had several episodes that have caused concern for my childrens safety when they are with their father. Luckily he has been traveling with work and visits are few and far between. We live in the same family home and our living situation is working well for them. He has threatened to leave the state with them and is now pushing for more frequent visits. I have had to send him away for being intoxicated when trying to have visitation. How difficult is it to otain full custody of my children.

You have to show that, it is in the best interest of the children, that they would be better with you than with their father. Remembering that there is a presumption in the law that states, that it is in the best interest of the children to have both parents involved in their care. You need to hire an experienced law firm to help you.

Like most non-attorneys you misuse the term "full custody." Custody has to do with your rights and duties as a parent. Possession and Access defines who spends how much time with the children and under what conditions.

You do need to talk with a good family law attorney about your options in this matter. Good work.
