Legal Question in Family Law in Utah
Hi. I have been separeated since November 2010 when I moved out. We are house owners but I resingned to my part verbally with my ex- husband. Now he tells me he cant afford house payments so he wants to go to short sale but I dont want to do that. He says if I dont agree he will simply stop payment and we will go to foreclosure. I need to start divorce papers asap but I know he wont sign anything for me and I am very desoriented not knowing what to do. Thank you for you time and advise. Alexandra

If you cannot afford the house payments, short sale may be best. If you can, you may be able to do something, but you have to act quickly. More information is needed to answer more fully. You call him your ex-husband yet you say you need to start divorce papers... If you have not yet got a divorce, you can ask for temporary orders to take possession of the home and make the payments, if you are able. Most likely, if he does not want to help, to make sure you act quick enough, get an attorney.
