Legal Question in Criminal Law in Vermont
Driving While Intoxicated
I recently was cited for DWI and was told that this is my second offense. The first was back in 1984-85. Is this correct? I tried looking for the law in VT pertaining to this and cannot locate any information. I am worried that this can be true even though it was almost 15 years ago. I have nothing on my license and haven't since that one DWI. Thank you for your time and consideration.

It seems that each state has its own look back period that can range from lifetime to a shorter period of time, for example, 5 years. I am licensed only in Montana and cannot advise you on Vermont's laws, but DWI laws have become complicated. I suggest you speak to an experienced Vermont attorney who aggressively and successfully fights DWI cases. Someone like that can properly advise you on the law as well as how to fight your case.
