Contract Validity

If someone has knowledge that a person is under the influence of alcohol, yet enters into a business contract with them regardless, is the contract enforceable?

Re: Contract Validity

It depends on all the facts and circumstances.

There are some cases where the court has held

that contracts signed by intoxicated people

are valid. It would be difficult to prove that

simply because someone is intoxicated, the

contract is invalid. On the other hand, if someone

is incompetent because they are an alcoholic,

the contract may be subject to challenge.
