Legal Question in Business Law in Virginia

Fraudulent Advertising

Not sure what category this is but here is my question. I paid $45 to Axis Global for a background check and access to their client database. I was told that they had straight data entry positions. After paying the money they have nothing available except recruiting for them. I told them I wanted a copy of the background check and they told me no, it was for their records only. Do I not at least have the right to get a copy of it? I know they will not give me my money back.

Thank you.

Re: Fraudulent Advertising

First, if background check included credit and/or criminal convictions checks, then these two background reports/results should be provided to you especially if they were considered in Axis Global's decision to hire you or not. In addition, in VA, Axis may not ask you certain information about your criminal record.

Second, you should refer to any agreement or Terms of Use that you signed, checked, accepted, or otherwise agreed to when you paid the $45. What does the agreement say?

Third, there is an article on the web that you might want to read at http://www.venable.com/publications.cfm?action=view&publication_id=541&publication_type_id=2
