Legal Question in Civil Rights Law in Virginia

i rented a room in my home to an elderly guy, after 3 years, i started working from home and now need that space, i gave him 3 months notice he has made no real attempt to find a place. I told him he needed to be gone by a said date. I put it in writing on a monday i was changing the locks that day and he needed to make arrangements for his belongs. He waits until the night before to tell me i cannot kick him out it is illegal. That night I gave him a 30 day written notice. I have a court date for the day after the 30 day notice expires. He is claiming he has medical conditions. As he lives in my home would a judge allow him to stay in my home. By the time of the court date he would have had 3 months verbal please leave and a 30 day eviction notice.

It t would appear that you'll have to wait for the court date and secure a

proper court order for eviction of this tenant as any other

landlord would have to do under similar circumstances.
