Legal Question in Credit and Debt Law in Virginia

Wage Garnishments?

I am being asked to pay through wage garnishments for a credit card debt that my former husband rejects to pay although I was a housewife with no income when married to him (yes my name was also in the account), He left the country in order to avoid paying child support and alimony (owing now more than a miliion dollars)and upon his return he declared bankruptcy.....he is a practicing heart physician in Orlando Florida. I put myself through school with 4 kids and now that I work as a self employed Family Therapist this attorneys representing the former Marine Midland Bank want to collect from me through the firm that provides me my clients and source of income.

Can they collect even though I am self employed? any way to stop them?

Re: Wage Garnishments?

Apart from filing bankruptcy yourself, you can't stop the garnishment. However, you may be able to claim exemptions, but the exemptions will run out, so you will just delay the inevitable. However, if the garnishee firm just refers you clients, and the clients pay on their own, then there is nothing to garnish. You may want to try to work out a settlement with the credit card company. Note also that if your ex-husband's bankruptcy filing is recent, you may be able to avoid the discharge of his obligation (if it exists in your separation agreement or divorce decree) to you that he indemnify you for this debt. But if you missed the deadline in his bankruptcy, you are out of luck there. Note that his alimony and support obligations were not discharged.
