Legal Question in Criminal Law in Virginia

I was convicted of the misdemeanor offense of �Manufacture Marihuana Intent Distribute� on October 6, 1977, in the General District Court of Floyd County, Virginia. I was put on probation for one year and completed my 1977 sentence. I now need to have this expunged in order to apply for residency in Spain. If it cannot be expunged what law proves this. Please help. I am about to get deported for this 40some year old sentence. I am desperate. Thank you

No, I regret to report that Va. Code Sec. 19.2-392.2 et seq. generally

prohibits the expungement of criminal records in the Commonwealth

unless the petitioner can prove that s/he was wrongfully convicted

and as a consequence thereof has received a pardon from the governor.
