Legal Question in Criminal Law in Virginia

gun ownership

Is it possible to expunge a Class I Misdemeanor Assault and Battery that went to J&D court? I would really like to be able to own a firearm again. I have been 10 years since the conviction without any legal infraction even a traffic ticket.

Re: gun ownership

If you are convicted of any crime, you can not petition for expungement. Expungement is only a possibility if you were acquitted of the charges or the case was nolle prossed or dismissed. In order to restore your right to own a firearm, your only course of action would be to petition the governor for a pardon.
