Legal Question in Criminal Law in Virginia

Small claims court questions

Hello- I have been dealing with an ex for several months now, and I believe I may have enough to file a suit for damages in small claims court. He has vandalized both of my cars (one of which I have proof- he took pictures of himself holding fuses/wires he pulled out), and the other was keyed with the tires slashed. He has kept a laptop computer and an expensive bass guitar that I bought for him- both with verbal agreements that he would pay me back. I have receipts for the laptop, the bass, and all the car repairs. He has also been harassing myself and my current boyfriend (I have all messages he's sent us both). Please advise.. would I have a case in small claims? Would it be wise to contact a lawyer to represent me in court? Thank you..

Re: Small claims court questions

Small claim courts in Virginia do not permit claimants to be represented by attorneys. However, it may be worth your while to hire a lawyer for a couple hours of his or her time to assist you with preparing and presenting your case in small claims court.

Some of your referenced items would appear to be compensable such as the laptop and the guitar.

(You may also wish to consider filing what's called a warrant in detinue for the return of these personal property items.)

However, regarding the harassment and a related claim for damages, you can pretty much forget about that.
