Legal Question in Family Law in Virginia

I have a 9 year old son who has his biological fathers last name. We were never married and he's not even on the birth certificate but we do have a child support order out. He hasn't see or talked to my son in 6 years, and hasn't paid a dime of child support. I got married a few years ago and my husband is the only man that my son knows as his dad. I want to change my sons last name to my husbands last name but his biological father won't consent, is there a way around this?
