Legal Question in Family Law in Virginia

My childrens father has been out of their lives for over 8 years, he does occassionally pay child support and I do not know where he is or how to contact him. I live in virginia and I am married, my husband would like to adopt them and I was wondering if there is a way to get sole custody and for the father to give up his rights to the kids?

You should be able to get sole custody. Adoption is much more difficult. The courts may want his consent. Is your new husband really wanting to adopt them. They will be treated as if they were his biologically. They will be able to inherit through him.
