can cps take a newborn if the other childeren are in foster care but im working to get them home with me, i just need a home fit for two toddlers but its fit for a newborn, im following the foster care assesment to get them back. im taking parenting classes and everything, do they have an legal right to ask for my grannys fingerprints and background check, and home check. if im working to get childeren back.

Yes, the Child Protective Services agency involved with your situation undoubtedly (in my opinion) has the right in the circumstances described to gather the evidence that it needs to properly evaluate for fitness the home environment of this newborn, and, perhaps, reevaluate as well for the same reason your home environment for your other children who are now apparently in foster care.
