I am thinking of divorcing my wife. If I move out is that considered desertion? Can she claim this in a battle for full custody of our kids?

Yes, she can claim that. It is not that simple to prove, however. Good luck.

Yes she could file for desertion. Be extremely careful about leaving before speaking with an attorney because you have children and leaving the house can affect custody!
