Legal Question in Family Law in Virginia

Father in and out of child's life

My ex and i share joint legal custody of our six year old son. He has seen the child twice in a one year period. (His choice) Now that we are a five weeks from yet another court date (he is over $2000.00 behind in child support) he has decided that he wants to drop back into my sons life. (He said that this was at the suggestion of his attorney.) What are my chances of getting full custody of my son and visitation only if the child wants to see his father? I have re-married and my son has begun calling my husband Dad. He has been more of a father to the child in the short time we have been married than his biological father has in six years.

Re: Father in and out of child's life

Your chances of getting the father's visitation curtailed in the manner you've suggested is unlikely to be determined by the court to be in the best interests of this child.
