Legal Question in Family Law in Virginia

Is it likely the judge will understand, and agree to the name change? My daughter's father and I were never married, and have a two year old daughter together. I have sole legal and physical custody. He is currently serving 14+ years for two sex obj, pen. charges and simple domestic assault, crimes against me. He is now registered under the sex offender registry. Our daughter carries his last name, and I would like to have it changed to mine. My concern is that as she gets older, she will carry the weight of her father's poor choices if she hold his last name. At this day an age, all it takes is a bit of information and few clicks on google. I want to protect her as she gets older from hurtful people, especially once she starts school.
