Legal Question in Family Law in Virginia

My Lawyer Won't Return Phone Calls About My Case

my lawyer will not move forward on my case. my divorce took over 5 years. i was awarded spousal support for 50 months. my ex has never paid one payment without taking him to court for arrears. my ex now owes me close to $7,000.00. i cannot get my lawyer to file a show cause on my behalf. should i try to handle this matter on my own?

i have also run up lawyer fee's that the ex owes to me and my lawyer in past contempt charges. i have also run up credit card bills trying to make ends meet depending on the spousal support. should i also file for extra money to pay off these credit card bills?

Re: My Lawyer Won't Return Phone Calls About My Case

A lawyer who refuses or fails to act(without credible excuse) within a reasonable period of time on a client's case should be discharged and new counsel retained.

The enforcement of your case should probably be transferred to the Juvenile and Domestic Relations District Court which then would give you the option of filing the contempt papers on your own and without the need for counsel.

I suggest you call the Virginia State Bar's office in Richmond to inquire about the propriety of your lawyer's behavior in your case.
