Legal Question in Family Law in Virginia

Mortage

I am currently waiting for my seperation from my XTB, I was ordred temporary possesion of the marital home we shared for 8 yrs. When he gave me the child support check he also gave me the mortage bill assumeing that I would be paying the $900.00. I was never ordered to pay this,it was never mentioned in court nor were the utility bills. Who generally pays for these things? I have been a stay at home mother since our marriage, and have been going to nite school for 3 yrs.

Re: Mortage

I'm not sure why it wasn't mentioned in court. The payment of your maintenance or the maintenance of the children are proper subjects in temporary divorce matters. Typically a man is ordered to pay child support and spousal support. Spousal support covers the woman's need for supplementation for the payment of regular bills pending the completion of a divorce case. If there is no court order on the matter, you need to get one. Until that time, the bills are unsettled and often times bills go into collection or foreclosure.

As always you need a competent attorney to see you through this.

Good luck.
