Legal Question in Family Law in Virginia

moving to Texas with minor child

Our son is wanting to move back to Texas- he has custody of his 5 year old daughter. What are Virginia laws pertaining to this- I think in his custody papers it states he has to give 30 days notice to the other parent-- does that mean before he moves or within 30 days after he moves? They were never married so it was not a divorce- just custody.

Re: moving to Texas with minor child

Your son must give 30 days advance notice to both the court issuing the custody order as well as the mother before he attempts to leave Virginia and move to Texas with the child.
